AMENDMENT IN THE EMPLOYEE COMPENSATION ACT

                         

                         THE EMPLOYEE'S COMPENSATION (AMENDMENT) ACT, 2017

Brief about the Act:

The Act provides for payment of compensation to the worker injured during the course of employment or contracted by any occupational disease peculiar to that employment. The liability for payment of compensation arises under the following situations:

·       A workman is entitled to get compensation from his employer if he is injured while on duty and during the course of his employment with his employer.

·       If a workman dies due to the accident while off duty and during the course of his employment with his employer, his dependents are entitled to receive the amount of compensation from his employer.

·       If a workman contacts occupational diseases enlisted in Schedule III of this Act, while on duty and during the course of his employment with his employer, the said disease shall be deemed to be an injury by accident.  The workman or if dead, his dependents are entitled to receive the amount of compensation from his employer.

AMENDMENTS:


Date of applicability:    12th April, 2017


·   New Section "17A” has been introduced in which every employer shall immediately at the time of employment of an employee, inform the employee of his rights to compensation under this Act, in writing as well as through electronic means, in English or Hindi or in the official language of the area of employment, as may be understood by the employee.".

·    Failure to inform shall attract the penalty of INR 50,000. Penalty under the section mentioned under Section 18A has been inserted.

·  1st Proviso to Section 30 (which provides for the appeal to the High Court against the order of the Commissioner) has been amended by providing the no dispute shall be admissible if the amount of dispute is less than INR 10,000.

·       Section  30A of the Act has been omitted from the Act.
